PsychRights Update

Hello,

This is to update you on the stay pending appeal situation with Mr. Bigley.  The Alaska Supreme Court denied reconsideration, thereby leaving the original stay order in place.  I think the stay order is very important because it was granted on the basis we had shown Mr. Bigley faced the danger of irreparable harm if the hospital was allowed to drug him during the pendency of the appeal.

The Alaska Supreme Court also sua sponte (on its own) ordered the parties to file short briefs by July 7th addressing whether the appeal should be expedited.   One assumes the order is in response to the hospital's argument in its motion for reconsideration that the stay "effectively precludes API from administering medication for Mr. Bigley during this, or any future, commitment periods."  However, Mr. Bigley has an interest in expediting the appeal to try and get an order for a less intrusive alternative more quickly, rather than having him dumped out of the hospital with no support, only to be picked up by the police, etc.
